Chapter I General Rules
Article 1 These Provisions are formulated in accordance with the Regulations on Safety Supervision of Special Equipment for the purpose of strengthening the work of safety supervision of Hoisting Machinery, preventing and reducing accidents of Hoisting machinery, and ensuring personal and property safety.
Article 2 The manufacturing, installation, transformation, maintenance, use, inspection, testing and supervision and inspection of lifting machinery shall comply with these Provisions.
The supervision and administration of the installation and use of lifting machinery used in building construction sites and municipal engineering sites shall be carried out in accordance with the provisions of relevant laws and regulations.
Article 3 The General Administration of Quality Supervision, Inspection and Quarantine (hereinafter referred to as the AQSIQ) shall be responsible for the safety supervision of lifting machinery throughout the country, and the local departments of quality and technical supervision at or above the county level shall be responsible for the safety supervision of lifting machinery within their respective administrative areas.
Chapter II Hoisting Machinery Manufacturing
Article 4 A manufacturing unit shall obtain a license for the manufacture of lifting machinery according to law before engaging in the corresponding manufacturing activities.
The manufacturing license of hoisting machinery shall be administered at different levels. The manufacturing unit shall meet the corresponding conditions for obtaining the manufacturing license, and the specific requirements shall be implemented in accordance with the relevant safety technical specifications and other provisions.
Article 5 The validity period of the hoisting machinery manufacturing license is 4 years.
The manufacturing unit shall submit a written application for renewal of the license six months before the expiration of the license; After examination, the licensing department shall make a decision on granting or disapproving the license before the expiration of the validity period.
Those who have not renewed their hoisting machinery manufacturing license upon expiration of its validity period shall not continue to engage in hoisting machinery manufacturing activities.
Article 6 The manufacturing unit shall adopt lifting machinery design documents that meet the requirements of safety technical specifications.
Article 7 For lifting machinery products and components subject to type test or new products and components of lifting machinery for trial production, type test of the whole machine or components must be conducted in accordance with the requirements of safety technical specifications.
Article 8 The manufacturing process of hoisting machinery shall be supervised and inspected by the inspection and testing institutions in the place where it is manufactured in accordance with the scope, items and requirements specified in the safety technical specifications.
Article 9 A manufacturing unit shall manufacture lifting machinery in a licensed place. However, if the structure cannot be split and the transportation exceeds the limit, it can be manufactured on the site of use and supervised and inspected by the inspection and testing institutions at the location of the manufacturing site in accordance with the requirements of safety technical specifications and other requirements.
Article 10 A manufacturing unit shall not entrust all the main bearing structural parts (main beam, main and auxiliary boom, main supporting leg, standard joint, the same below) to be processed or purchased and used in the manufacturing of lifting machinery.
If the main bearing structural parts need to be processed or purchased by commission, the manufacturing unit shall entrust the processing or purchase the main bearing structural parts processed by the manufacturing unit that has obtained the corresponding type and grade qualification of lifting machinery and use them in the manufacturing of lifting machinery.
Article 11 When lifting machinery leaves factory, it shall be accompanied by design documents (including general drawing, drawing of main mechanical structure parts, mechanical transmission drawing and schematic drawing of electrical and hydraulic systems), product quality certificate, instructions for installation, use and maintenance, supervision and inspection certificate, certificate of passing related type test and other documents.
Chapter III Installation, Transformation and Maintenance of Hoisting Machinery
Article 12 Units that install, reform or maintain lifting machinery shall obtain permission for installation, reform or maintenance according to law before engaging in corresponding activities.
The installation, renovation and maintenance of hoisting machinery shall be managed at different levels. The installation, renovation and maintenance units shall meet the corresponding conditions for obtaining the installation, renovation and maintenance licenses, and the specific requirements shall be implemented in accordance with the relevant safety technical specifications and other provisions.
To engage in lifting machinery reconstruction activities, they shall have lifting machinery manufacturing capabilities of corresponding types and levels.
Article 13 The validity period of the license for installing, reforming and maintaining lifting machinery is 4 years.
The unit that installs, renovates or maintains the license shall submit a written application for renewal 6 months before the expiration of the license; After examination, the licensing department shall make a decision on granting or disapproving the license before the expiration of the validity period.
Those who have not renewed their license after the expiration of their license for installing, reforming or maintaining lifting machinery shall not continue to engage in the activities of installing, reforming or maintaining lifting machinery.
Article 14 The units engaged in installation, renovation and maintenance shall inform the quality and technical supervision department in accordance with the relevant provisions, and shall not begin construction until such notification is made.
For the lifting machinery that needs to be reinstalled in mobile operation, if it is installed in a different place, it shall inform the quality and technical supervision department in the place where construction is taking place before construction.
The pre-construction notification shall be in written form, including: name of the unit, license number and contact information, name and contact information of the user, construction project, lifting machinery to be constructed, supervision and inspection certificate number, type test certificate number, construction site, construction scheme, construction date, name list of licensed operators, etc.
Article 15 Units engaged in installation, renovation or major maintenance shall, prior to construction, apply to the inspection and testing institutions in the place where construction is taking place for supervision and inspection.
The inspection and testing institution shall go to the construction site for supervision and inspection, which shall be carried out in accordance with the requirements of the corresponding safety technical specifications.
Article 16 An installation, reconstruction or maintenance unit shall, within 30 days after acceptance of construction, hand over the technical data of installation, reconstruction or maintenance to the user unit.
Chapter 4 Use of Hoisting Machinery
Article 17 Before hoisting machinery is put into use or within 30 days after it is put into use, the user shall register with the registration department in accordance with relevant provisions.
For floating lifting machinery, the user shall go through registration with the registration department where the property right unit is located.
Article 18 If the user of hoisting machinery is changed, the original user shall, within 30 days after the change, go through the cancellation of the use registration with the original registration department. The new user shall, in accordance with relevant provisions, go through the registration formalities at the local registration department.
Article 19 If lifting machinery is scrapped, the user shall go to the registration department for cancellation of use registration.
Article 20 Units using lifting machinery shall perform the following obligations:
(1) The use of lifting machinery manufactured by units with corresponding licenses and qualified by supervision and inspection;
(2) Establish and improve the corresponding safety management system for the use of hoisting machinery;
(3) To set up safety administration organs for hoisting machinery or to appoint special (and part-time) safety administration personnel for hoisting machinery safety administration;
(4) Conduct safety technical training for crane operators to ensure that they master operation skills and knowledge of accident prevention, and enhance safety awareness;
(v) To carry out daily maintenance and record the main mechanical structure parts, safety accessories, safety protection devices, operating mechanisms, control systems, etc., of lifting machinery;
(6) Equip with rigging and slings that meet safety requirements, strengthen daily safety inspection and maintenance, and ensure the safe use of rigging and slings;
(7) Formulate emergency rescue plans for hoisting machinery accidents, set up emergency rescue teams according to needs, and conduct regular drills.
Article 21 The user unit shall establish a hoisting machinery safety technical file. Hoisting machinery safety technical files shall include the following contents:
(1) Design documents, certificates of product quality qualification, certificates of supervision and inspection, installation technical documents and materials, instructions for use and maintenance;
(2) Type test certificate of safety protection device;
(3) periodic inspection reports and records of periodic self-inspection;
(4) Records of daily use;
(5) Daily maintenance records;
(vi) operation failure and accident records;
(7) Use registration certificate.
Article 22 The maximum periodic inspection period of hoisting machinery shall not exceed 2 years. The inspection period of different categories of hoisting machinery shall be carried out according to the corresponding safety technical regulations.
The user unit shall submit an application for periodic inspection to the inspection and testing institution one month before the expiry date of periodic inspection.
Where floating lifting machinery is used in other places, the user unit shall apply for periodic inspection to the inspection and testing institution in the place where it is used according to the requirements of inspection period and so on, and the user unit shall report the inspection results to the registration department.
Article 23 Used lifting machinery may be put into use only if it meets the following requirements:
(1) having the certificate of cancellation of the registration of the original user;
(2) It has the registration certificate of the new user;
(3) having complete safety technical files;
(4) Supervise and inspect and pass regular inspection.
Article 24 The lessee and user of hoisting machinery shall, in accordance with the provisions of Item (5) of Article 20 of these Provisions, carry out daily maintenance and record of hoisting machinery during the period of tenancy, and be responsible for the safety of the use of hoisting machinery.
It is prohibited to hire the following lifting machinery:
(1) It has not registered its use with the registration department;
(2) It does not have complete safety technical files;
(3) failing to pass supervision and inspection or periodic inspection.
Article 25 The disassembly of lifting machinery shall be carried out by units with corresponding installation licenses.
Before lifting machinery disassembly construction, careful disassembly instructions shall be formulated, and construction shall be carried out in accordance with the requirements of disassembly instructions to ensure the safety of lifting machinery disassembly process.
Article 26 If lifting machinery is under any of the following circumstances, the unit using it shall scrap it in time and take such destruction measures as disassembling it:
(1) where there are potential serious accidents and there is no value for reconstruction or maintenance;
(2) It has reached the designed service life or the conditions for scrapping as stipulated in the safety technical specifications.
Article 27 If lifting machinery fails or has abnormal conditions, the unit using it shall stop using it and make a comprehensive inspection to eliminate the faults and hidden dangers of accidents before putting it back into use.
Article 28 In case of an accident involving hoisting machinery, the user must, in accordance with the relevant provisions and requirements, timely report to the local departments of quality and technical supervision and other relevant departments.
Chapter V Supervision and Inspection
Article 29 The quality and technical supervision department shall, in accordance with the Regulations on Safety Supervision of Special Equipment and these Provisions and other relevant requirements, conduct safety supervision over the manufacturing, installation, transformation, maintenance, use, inspection and testing of lifting machinery.
Article 30 When engaging in safety supervision activities, safety supervision personnel and other administrative law enforcement personnel of quality and technical supervision departments shall be loyal to their duties, adhere to principles, enforce the law impartially and according to law.
Article 31 In the course of safety supervision, where the quality and technical supervision department needs the support and cooperation of the local people's government and relevant departments to deal with the hidden dangers of hoisting machinery accidents or illegal acts, it shall timely report or notify the local people's government and relevant departments.
Article 32 The investigation and handling of hoisting machinery safety accidents shall be carried out in accordance with relevant State regulations.
Chapter VI Legal Liability
Article 33 Anyone who violates Article 6 of these provisions shall be ordered to make corrections and be fined between 20,000 yuan and 30,000 yuan.
Article 34 Where a manufacturing unit, in violation of the provisions of Article 9 of these Provisions, fails to manufacture lifting machinery in licensed places, it shall be ordered to make corrections and be fined not less than 20,000 yuan but not more than 30,000 yuan.
Article 35 Anyone who violates the provisions of the first or second paragraph of Article 10 of these Provisions shall be ordered to make corrections and be fined not less than 10,000 yuan but not more than 30,000 yuan.
Article 36 Where the user unit of hoisting machinery is changed and the original user unit, in violation of the provisions of Article 18 of these Regulations, fails to handle the cancellation of the use registration with the original registration department within 30 days after the change, it shall be ordered to make corrections and be fined not less than 2,000 yuan but not more than 20,000 yuan.
Article 37 Whoever uses lifting machinery that does not meet the requirements of Item (1) of Article 23 of these Regulations shall be ordered to make corrections and be fined between not less than 2,000 yuan and not more than 20,000 yuan.
Article 38 Anyone who violates Paragraph 2 of Article 24 of these Provisions shall be ordered to make corrections and be fined not less than 2,000 yuan but not more than 20,000 yuan.
Article 39 Anyone who violates the provisions of Paragraph 2 of Article 25 of these Provisions shall be ordered to make corrections and be fined not more than 10,000 yuan.
Article 40 Whoever violates other requirements of these provisions and constitutes an illegal act as prescribed in Regulations on Safety Supervision of Special Equipment shall be punished according to such provisions.
Article 41 Administrative law enforcement personnel such as safety supervisors of hoisting machinery who abuse their power, neglect their duties or engage in malpractices for personal gain in their work shall be investigated for legal liability according to law.
Chapter 7 Supplementary Provisions
Article 42 The lifting machinery mentioned in these Provisions refers to the lifting machinery prescribed in Article 88 of the Regulations on Safety Supervision of Special Equipment, including its attached safety accessories and safety protection devices.
The specific categories (types) and varieties (types) of lifting machinery shall be carried out in accordance with the catalogue approved by The State Council.
Article 43 The meanings of the following terms in these Provisions are:
Transformation refers to the activity that changes the original performance parameters and technical indicators by changing the main mechanical structure parts, main materials, main configuration and control system of the original hoisting machinery.
Maintenance refers to the repair activities that disassembly or replacement of original main parts, adjustment of control system, replacement of safety accessories and safety protection devices, but do not change the original performance parameters and technical indicators of lifting machinery.
