Regulations on Safety Supervision of Lifting Machinery (New Edition)

  Chapter 1 General Provisions

  Article 1: These Regulations are formulated in accordance with the "Special Equipment Safety Supervision and Administration Regulations" to strengthen safety oversight of lifting machinery, prevent and reduce lifting machinery accidents, and ensure the safety of both persons and property.

  Article 2: The manufacturing, installation, modification, maintenance, operation, inspection, testing, and related supervision and inspection of lifting machinery shall comply with these Regulations.

  The supervision and management of the installation and use of lifting machinery at housing construction sites and municipal engineering sites shall be carried out in accordance with relevant laws and regulations.

  Article 3: The State Administration for Market Regulation (hereinafter referred to as SAMR) is responsible for the nationwide safety supervision of lifting machinery, while local quality and technical supervision departments at or above the county level are tasked with overseeing the safety of lifting machinery within their respective administrative regions.

  Chapter 2: Manufacturing of Lifting Machinery

  Article 4: Manufacturing entities must obtain a lifting machinery manufacturing license in accordance with the law before engaging in relevant manufacturing activities.

  Lifting machinery manufacturing licenses are subject to tiered management. Manufacturing entities seeking a license must meet specific criteria, with detailed requirements governed by relevant safety and technical regulations.

  Article 5: The validity period of the lifting machinery manufacturing license is 4 years.

  Manufacturing entities must submit a written application for license renewal at least 6 months before the current license expires. After review, the licensing authority shall issue a decision—either granting or denying the renewal—before the license’s expiration date.

  A lifting machinery manufacturing license that has expired without being renewed may not be used to continue lifting machinery manufacturing activities.

  Article 6: Manufacturing units shall use lifting machinery design documents that comply with the requirements of safety technical specifications.

  Article 7: According to the requirements of safety technical specifications, lifting machinery products, components, or newly developed lifting machinery products and components undergoing prototype testing must undergo full-machine or component-type tests.

  Article 8: The manufacturing process of lifting machinery shall be subject to supervisory inspection by an inspection and testing organization located in the place of manufacture, conducted according to the scope, items, and requirements specified in safety technical regulations and other relevant standards.

  Article 9: Manufacturing units shall carry out the production of lifting machinery within their licensed premises; however, for components that cannot be disassembled and exceed transportation limits, manufacturing may take place at the installation site. In such cases, the inspection and testing organization located at the manufacturing site will conduct supervisory inspections in accordance with safety technical specifications and other relevant requirements.

  Article 10: Manufacturing units shall not entrust the complete processing or purchase of all primary load-bearing structural components (such as main beams, main and auxiliary booms, main support legs, and standard sections, hereinafter referred to as "standard sections") for use in lifting machinery manufacturing.

  For key load-bearing structural components that require partial outsourcing for fabrication or outright purchase, the manufacturing entity must entrust these tasks to a manufacturer holding the appropriate lifting machinery type and level qualifications, ensuring that the fabricated or purchased components meet the necessary standards for use in the construction of lifting equipment.

  Article 11: When lifting machinery leaves the factory, it must be accompanied by design documents (including general drawings, drawings of major load-bearing structural components, mechanical transmission diagrams, and schematics of electrical and hydraulic systems), certificates of product quality compliance, installation, usage, and maintenance instructions, supervision and inspection certificates, and relevant type-test qualification certificates.

  Chapter 3: Installation, Modification, and Maintenance of Lifting Equipment

  Article 12: Units engaged in the installation, modification, or maintenance of lifting machinery must obtain the appropriate installation, modification, or repair permits as required by law before undertaking such activities.

  Lifting machinery installation, modification, and repair permits are subject to tiered management. Installation, modification, and repair entities seeking these permits must meet specific eligibility criteria, with detailed requirements governed by relevant safety technical standards and regulations.

  Those engaged in lifting machinery modification activities must possess manufacturing capabilities for lifting machinery of the corresponding type and level.

  Article 13: The validity period of the license for installation, modification, and maintenance of lifting machinery is four years.

  Installation, renovation, and maintenance organizations must submit a written application for license renewal at least 6 months before the current license expires. After review, the licensing authority shall issue a decision to either grant or deny the renewal prior to the expiration date.

  If the validity period of a license for lifting machinery installation, modification, or maintenance has expired and has not been renewed, the licensee is prohibited from continuing lifting machinery installation, modification, or maintenance activities.

  Article 14: Units engaged in installation, modification, or maintenance activities must notify the quality and technical supervision department as required before commencing work.

  For lifting machinery undergoing convection operations and requiring reinstallation when moved to a different location, installation must be carried out only after notifying the local quality and technical supervision authority at the construction site as per regulations.

  Prior to construction, notification must be provided in writing, including the following details: the name of the unit, the license certificate number and contact information, the name and contact details of the using entity, the specific construction project, the lifting equipment intended for use, the numbers of the supervision and inspection certificates and type-test certificates, the construction site, the proposed construction plan, the scheduled construction dates, and a list of certified operators.

  Article 15: Units engaged in installation, modification, or major repairs shall apply to the inspection and testing agency at the construction site for supervisory inspection prior to commencing work.

  Inspection and testing organizations shall conduct supervisory inspections at the construction site, following the requirements of relevant safety technical specifications and other applicable standards.

  Article 16: Installation, renovation, and maintenance units shall transfer the technical documentation for installation, renovation, and maintenance to the user unit within 30 days after construction and acceptance.

  Chapter 4: Operation of Lifting Machinery

  Article 17: Before a lifting machine is put into service or within 30 days after it begins operation, the using unit must, as required, complete the usage registration at the designated registration authority.

  For mobile lifting machinery, the using unit shall register its use with the registration authority located at the property owner's premises.

  Article 18: If the entity using lifting machinery changes, the original user must, within 30 days after the change, go to the original registration authority to cancel the usage registration. The new user, meanwhile, must complete the usage registration at the local registration authority as required.

  Article 19: If a lifting machine is scrapped, the user unit shall go to the registration authority to cancel its usage registration.

  Article 20: The entity using lifting machinery shall fulfill the following obligations:

  (1) Use lifting machinery manufactured by qualified units with appropriate licensing and certified as compliant through supervised inspection;

  (II) Establish and improve the corresponding safety management system for lifting machinery;

  (III) Establish a lifting machinery safety management organization or assign dedicated (or part-time) safety personnel to oversee the safe operation of lifting machinery;

  (IV) Provide safety and technical training for lifting machinery operators, ensuring they master operational skills and accident-prevention knowledge, while enhancing their safety awareness.

  (5) Perform daily maintenance and upkeep on the main load-bearing structural components, safety devices, safety protection systems, running mechanisms, control systems, and other critical parts of lifting machinery, and keep detailed records.

  (6) Equip with rigging and lifting devices that meet safety requirements, strengthen daily safety inspections and maintenance, and ensure the safe use of rigging and lifting equipment.

  (7) Develop an emergency rescue plan for lifting machinery accidents, establish emergency response teams as needed, and conduct regular drills.

  Article 21: The using organization shall establish safety technical files for lifting machinery. These files must include the following contents:

  (1) Design documents, certificates of product quality, supervision and inspection certificates, installation technical documents and data, as well as operation and maintenance instructions;

  (II) Type-test certificate for the safety protection device;

  (III) Regular inspection reports and records of periodic self-checks;

  (IV) Daily Usage Records;

  (5) Daily Maintenance and Inspection Records;

  (6) Records of Operational Failures and Accidents;

  (7) Use the registration certificate.

  Article 22: The periodic inspection interval for lifting machinery shall not exceed 2 years, and the inspection intervals for different categories of lifting equipment shall be governed by the relevant safety technical regulations.

  The using organization should submit a request for periodic inspection to the inspection and testing agency one month before the expiration date of the current validity period.

  When mobile lifting machinery is used in a location different from its registered site, the using unit must apply for periodic inspections from the inspection and testing agency in the place of use, following the inspection schedule and other relevant requirements. Additionally, the using unit shall submit the inspection results to the registration authority.

  Article 23: Old lifting machinery must meet the following requirements before the using unit can put it into service:

  (1) A certificate confirming the cancellation of the usage registration from the original user unit;

  (II) A usage registration certificate with a new user entity;

  (III) Possessing a complete safety technical file;

  (IV) Passed supervision and periodic inspections.

  Article 24: The leasing and using unit of lifting machinery shall, in accordance with item (v) of Article 20 of these Regulations, conduct daily maintenance and upkeep of the lifting machinery during the rental period and keep detailed records. They shall also be responsible for ensuring the safe operation of the rented lifting equipment.

  The following lifting machinery is prohibited from being leased or used:

  (1) Not registered for use with the registration authority;

  (II) Lacking a complete safety technical file;

  (III) Those that fail supervision or periodic inspections.

  Article 25: The dismantling of lifting machinery shall be carried out by a unit holding the appropriate installation licensing qualification.

  Before dismantling construction of lifting machinery, a detailed dismantling operation manual must be prepared. Construction should then proceed strictly according to the instructions in the manual, ensuring safety throughout the entire dismantling process.

  Article 26: If a lifting machine falls under any of the following circumstances, the user unit shall promptly scrap it and take disposal measures such as dismantling or destruction:

  (1) There is a serious safety hazard, and the equipment is beyond repair or refurbishment;

  (II) Having reached the design service life or scrapping conditions specified in safety technical regulations and other relevant standards.

  Article 27: If a lifting machine malfunctions or experiences an abnormal condition, the using unit must immediately cease operation, conduct a thorough inspection, and only resume use after eliminating both the malfunction and any potential safety hazards.

  Article 28: In the event of a lifting machinery accident, the using unit must promptly report to the local quality and technical supervision department and relevant authorities as required by applicable regulations.

  Chapter 5: Supervision and Inspection

  Article 29: The quality and technical supervision department shall conduct safety inspections of the manufacturing, installation, modification, maintenance, use, and inspection/testing of lifting machinery, in accordance with the "Special Equipment Safety Supervision and Administration Regulations" and other relevant requirements outlined in these provisions.

  Article 30: Safety inspectors and other administrative law enforcement personnel from the quality and technical supervision department, when conducting safety inspection activities, shall remain dedicated to their duties, uphold principles, enforce the law impartially, and ensure compliance with legal regulations.

  Article 31: When carrying out safety inspections, the quality and technical supervision department, if it requires support and cooperation from the local people's government and relevant departments in addressing potential hazards or illegal activities related to lifting machinery, shall promptly report or notify the local authorities and pertinent departments.

  Article 32: Investigation and handling of lifting machinery safety accidents shall be carried out in accordance with relevant national regulations.

  Chapter 6: Legal Liability

  Article 33: Those who violate Article 6 of these Regulations shall be ordered to make corrections and fined between 20,000 and 30,000 yuan.

  Article 34: If a manufacturing entity violates Article 9 of these Regulations by failing to produce lifting machinery within its licensed premises, it shall be ordered to make corrections and fined between 20,000 and 30,000 yuan.

  Article 35: Any violation of Paragraph 1 or Paragraph 2 of Article 10 of these Regulations shall be subject to an order for rectification and a fine ranging from RMB 10,000 to RMB 30,000.

  Article 36: If the entity using lifting machinery undergoes a change, and the original user violates Article 18 of these regulations by failing to cancel the usage registration with the original registration authority within 30 days after the change, they will be ordered to rectify the situation and fined between 2,000 and 20,000 yuan.

  Article 37: Any entity using lifting machinery that does not meet the requirements specified in Article 23, item (1) of these Regulations shall be ordered to make corrections and fined between 2,000 yuan and 20,000 yuan.

  Article 38: Any violation of Paragraph 2 of Article 24 of these Regulations will result in an order to rectify the issue and a fine ranging from 2,000 yuan to 20,000 yuan.

  Article 39: Any violation of Paragraph 2 of Article 25 of these Regulations will result in an order to rectify the issue and a fine of up to RMB 10,000.

  Article 40: Any violation of other requirements under these regulations that constitutes an illegal act as defined in the "Special Equipment Safety Supervision and Inspection Regulations" or other relevant provisions shall be subject to penalties as prescribed therein.

  Article 41: Administrative law enforcement officers, including safety inspectors for lifting machinery, who abuse their authority, neglect their duties, or engage in corruption during their work shall be held legally accountable according to the law.

  Chapter 7: Supplementary Provisions

  Article 42: The lifting machinery referred to in these Regulations shall mean the lifting equipment specified in Article 88 of the "Special Equipment Safety Supervision and Administration Regulations," including their associated safety accessories and protective devices.

  The specific categories (types) and varieties (models) of lifting machinery shall be implemented according to the catalog approved by the State Council.

  Article 43: The following terms used in these Regulations shall have the meanings set forth below:

  Renovation refers to activities that involve altering the primary load-bearing structural components, key materials, major configurations, or control systems of an existing lifting machine, resulting in changes to its original performance parameters and technical specifications.

  Maintenance refers to repair activities that involve dismantling or replacing original major components, adjusting control systems, and replacing safety accessories and protective devices—without altering the lifting equipment's original performance parameters or technical specifications.

  Major maintenance refers to repair activities that involve dismantling or replacing the original primary load-bearing structural components, key equipment, or control systems—without altering the crane's original performance parameters or technical specifications.

  Article 44: The supervision and management of lifting machinery operators, inspection and testing organizations, and inspection and testing personnel shall be carried out in accordance with relevant regulations.

  Article 45: These Regulations shall be interpreted by the State Administration for Market Regulation.

  Article 46: These Regulations shall come into effect as of June 1, 2007.
